Trip Lanka, based in Perth, Western Australia, respects the intellectual property rights of others and expects the same in return. This policy explains how to notify us of alleged copyright infringement and how we will respond.

1. Overview

Trip Lanka operates a marketing and informational website. All images, text, photography, and media published on this website are either owned by Trip Lanka, licensed from third parties, or used with the express permission of the rights holder. We do not host user-generated content.

Trip Lanka voluntarily adopts a DMCA-style copyright takedown process as a matter of good faith and professional best practice. Our website and infrastructure are hosted on Amazon Web Services (AWS), a US-based service provider that is subject to the US Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. As an AWS customer, we are committed to responding promptly and appropriately to valid notices of alleged copyright infringement.

Trip Lanka's primary legal obligations with respect to copyright are governed by the Australian Copyright Act 1968 (Cth). This DMCA policy is provided voluntarily and does not limit our obligations or rights under Australian law.

2. Reporting Copyright Infringement

If you believe that any content published on the Trip Lanka website (triplanka.com.au) infringes your copyright, you may submit a written takedown notice to our designated copyright contact by email:

Please use email rather than our general enquiry form so that your notice is properly directed and time-stamped. We endeavour to acknowledge all takedown requests within 5–10 business days.

To be valid and actionable, your notice must contain all of the elements described in Section 3 below. Incomplete notices may not be acted upon.

3. Required Elements of a Takedown Notice

A valid copyright takedown notice under 17 U.S.C. § 512(c)(3) must include all six of the following elements:

  1. Your signature — A physical or electronic signature of the person authorised to act on behalf of the copyright owner. A typed full name (e.g. "/s/ Jane Smith") at the bottom of your email is sufficient.
  2. Identification of the copyrighted work — A description of the original work you claim has been infringed. If multiple works are covered, a representative list is acceptable. Include any registration numbers if available (not required).
  3. Identification of the infringing material — Specific URLs or direct links to every page or file on our website that you believe contains the infringing content. Vague descriptions are insufficient and may invalidate your notice.
  4. Your contact information — Your full name, postal address, telephone number, and email address.
  5. Good faith statement — A statement that you have a good faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law. Note: you must genuinely consider whether the use may constitute fair dealing or fair use before making this statement.
  6. Accuracy and perjury statement — A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorised to act on the owner's behalf.

Notices that do not contain all six elements may not be treated as valid DMCA notices and may not be acted upon.

4. Our Process

Upon receipt of a complete and valid takedown notice, Trip Lanka will:

  • Acknowledge receipt of the notice, typically within 5–10 business days.
  • Review the notice and assess whether the identified material appears to infringe the claimed copyright.
  • If appropriate, remove or disable access to the identified content while the matter is under review.
  • Notify the relevant party where required.
  • Respond to the claimant with the outcome of our assessment.

Receipt and processing of a takedown notice does not constitute an admission of any wrongdoing by Trip Lanka. Complex matters may take longer than the standard timeframe to assess, and we may seek further information before taking action.

5. Counter-Notification

If content belonging to Trip Lanka is removed by our hosting provider (AWS) in response to a third-party takedown notice, and we believe the removal was made in error or as a result of misidentification, we may submit a counter-notification under 17 U.S.C. § 512(g).

A valid counter-notification must contain all four of the following elements:

  1. Signature — A physical or electronic signature of the subscriber (the party whose content was removed).
  2. Identification of the removed material — A description of the content that was removed and the URL where it appeared before removal.
  3. Statement under penalty of perjury — A good faith statement that the material was removed or disabled as a result of mistake or misidentification of the material.
  4. Contact information and consent to jurisdiction — The subscriber's name, address, telephone number, and email address, together with a statement consenting to the jurisdiction of the Federal District Court for the judicial district where the subscriber is located (or any judicial district in which the service provider may be found if the subscriber is outside the US), and a statement that the subscriber will accept service of process from the person who submitted the original notice.

Important: Filing a counter-notification subjects the filer to the jurisdiction of US federal courts for the purposes of any court action the original claimant may bring. This is a significant legal step. Anyone considering submitting a counter-notification is strongly advised to seek independent legal advice before doing so.

Following receipt of a valid counter-notification, the service provider is generally required to restore the removed content within 10–14 business days, unless the original claimant files a court action in the interim.

6. Misuse Warning

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material was removed or disabled by mistake or misidentification, may be held liable for damages — including costs and legal fees incurred by the alleged infringer, the copyright owner, or the service provider as a result of the misrepresentation.

Trip Lanka reserves the right to seek all available remedies against any party who submits a false, fraudulent, or bad-faith takedown notice targeting our content.

7. Australian Copyright Law

Trip Lanka is an Australian company and our primary copyright obligations are governed by the Copyright Act 1968 (Cth). Key points relevant to this policy:

  • Automatic protection: Copyright in Australia arises automatically upon the creation of an original work. There is no registration requirement. Trip Lanka's original content — including copywriting, brand materials, and photography — is protected from the moment of creation.
  • Duration: Copyright in literary, dramatic, musical, and artistic works (including photographs) generally subsists for the life of the author plus 70 years.
  • Infringement remedies: Under the Copyright Act 1968, a copyright owner whose work is infringed may seek injunctive relief, damages (including additional damages for flagrant infringement), and account of profits in Australian courts.
  • Berne Convention: Australia and the United States are both signatories to the Berne Convention, meaning copyright works originating in either country are automatically protected in the other. This is the legal foundation for the practical effect of DMCA-style notices between Australian and US parties.
